Keeping information private and secure is critically important to us.  This privacy policy (this “Policy“) explains how personal information is collected, used, and disclosed by Bill White Restaurant Group properties, and its parent (collectively, “Bill White Enterprises” “we” “our” or “us“). We recognize the importance of protection the privacy of information collected about our users, and we operate in accordance with applicable data protection legislation. This privacy policy (this “Privacy Policy”) is intended to help you understand how we gather, use, and disclose information that you (“you” or “User” or “Visitor”) provide to us by visiting our sites, and with whom information is shared.

This Policy applies to visitors and users (individually, “you“) of Bill White Enterprise’s properties, websites, forms, and other online services (each, a “Site,” and collectively, our “Sites“), although not all services described here are available in all jurisdictions. By visiting or using our Sites, to the extent permitted by applicable law, you are consenting to us gathering and processing information about you in accordance with this Policy, although consent may not be required for all of the elements described in this Policy. For particular types of information or processing, we may provide you with choices or request your further consent related to what information we collect and how we may process it. Third parties (such processing sites, social networks, and other online applications that you use in connection with our Sites) may also collect, use, and share information about you. This Policy does not cover such third parties or their services and we do not take any responsibility for how such third parties may use any information they collect. Maintaining a website is an evolving process and we may need to change this Policy, in whole or in part, at any time, with or without advance notice, by posting a new Policy in its place. Your continued use of the Site following any changes to this Policy will constitute your acceptance of such changes at the time of use. I. INFORMATION WE COLLECT
Personal Information. By visiting or using our Sites, we may collect the following categories of personal information (“Personal Information“) you provide to us: name; email address; postal address; phone number (including your mobile phone number); other information you provide on our Sites; and other information you may provide about yourself or others to our Sites or to which you provide us with access via from third-party websites, applications, and services (each, a “third-party platform“).  We may combine this information with information we collect on our Sites.

Device Information. When you visit our Sites, some information is automatically collected from devices (e.g., mobile, computer, laptop, tablet) used to visit or use our Sites including, but not limited to, point of sale, operating system, settings, and other data about your device that we use to provide the services or as otherwise described in this Policy (“Device Information“).

II. HOW WE USE YOUR INFORMATION
Purposes.  We may use your Personal Information to provide you with the information, products or services that you have requested and, if applicable, charging you for the products or services you have ordered. We will share your Personal Information with third parties only in the ways that are described in this privacy policy. We do not sell your Personal Information to third parties. We may use Personal Information to provide important notices regarding our company and services. We may use Personal Information for internal purposes such as helping use develop, deliver and improve our products, services, content, and advertising. We may also enlist third parties to collect, store, process and manage Personal Information for Bill White Enterprises. The service providers with whom we conduct business are authorized to use Personal Information only to perform the service for which they are hired. When we use other companies to perform services on our behalf, we will require that such companies protect your Personal Information consistent with this Privacy Policy.

In addition, from time to time, we may offer you the opportunity to receive information, products or services directly from a third party. If you elect to receive such items, we may share your Personal Information as necessary to facilitate your request to receive items from any such third party. 

We may process or store your Personal Information in our systems and databases located in the United States where Bill White Enterprises operates. We may disclose Personal Information when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating our web site terms and conditions or other agreements with Bill White Enterprises, causing injury to or interference with (either intentionally or unintentionally) our web site, products, services or other rights or property. We may disclose Personal Information when we believe in good faith that the law requires it, such as a subpoena and for other governmental administrative, regulatory or law enforcement purposes.

Combined Information. We may combine your Personal Information with Device Information and location information (with your consent, where required) to serve you specifically, such as to deliver a specific offer to you according to your preferences or restrictions, or for advertising or advertising targeting purposes. When we combine Personal Information with Device Information in this way, we treat it as, and apply all of the safeguards in this Policy applicable to, Personal Information.

Electronic Communications. Consistent with the above Purposes, we may communicate with you via electronic messages, including email, text message, or mobile push notification to, example: for send you information relating to updates, and support and administrative messages; and/or, subject applicable law, communicate with you about contests, offers, promotions, rewards, upcoming events, and other news about products and services offered by Bill White Enterprises, our subsidiaries, our affiliates, restaurants, and other business partners.

Aggregated Information. We may aggregate information collected from you and other users as well as Device Information and location information (with your consent, where required) to produce general statistics that cannot be linked to you or any other specific user and with which we attempt to provide you with a better experience, to improve our services, and to analyze and understand how our goods and services are used.

Retention. We will retain your information for the period necessary to fulfill the Purposes outlined in this Policy and as otherwise needed to comply with applicable law and internal company policies.

III.  HOW WE SHARE YOUR INFORMATION
 Financial Information. In connection with conjunction with purchasing certain Bill White Enterprises goods and services, Financial Information consisting of financial qualifications and billing information may be required. Examples include a customer’s billing name and address and credit card number.  All Financial Information that we collect through our properties and websites are used solely to bill for the goods or services. Such information is not used by Bill White Enterprises for marketing or promotional purposes. Bill White Enterprises uses third-party intermediaries to manage the credit card processing. These intermediaries are solely a link in the distribution chain, and is not permitted to store, retain, or use the information provided, except for the sole purpose of credit card processing (we do not retain credit card numbers).

Our Sites may also allow you to connect with us on, share on, and use third-party platforms, including those on which Bill White Enterprises has a presence.

Please be mindful of your personal privacy needs and the privacy needs of others as you choose whom to connect with and what to share and make public. We cannot control the privacy or security of information you choose to make public or share with others. Bill White Enterprises also does not control the privacy practices of third-party platforms. Please contact those sites and services directly to learn about their privacy practices.

Request/Referrals.  If you choose to request an event or service from us and fill out the form for the best contact, we will ask you for your contact’s name, email address, phone number. We can get you in touch with a team member that can help learn about the specifics of your request. Bill White Enterprises stores this information for the sole purpose of contacting you. Testimonials.  We display personal testimonials of satisfied customers on our site in addition to other endorsements. With your consent, we may post your testimonial along with your name. If you wish to update or delete your testimonial, you can contact us at communications@bwrgpc.com.

IV. SECURITY OF YOUR INFORMATION
We use a variety of third-party security technologies and procedures to help protect your Information and the information on our Platforms from unauthorized access, use, or disclosure. For example, our third-party vendors store the Information you provide on computer systems with limited access, which are located in controlled facilities. Two-factor authentication is used for signing-in and when we transmit highly confidential information (such as a credit card number or password) over the Internet, we protect it through the use of encryption, such as the Secure Socket Layer (SSL) protocol. Bill White Enterprises cannot, however, ensure or warrant the security of any information you transmit to us by e-mail or via other web sites, and you do so at your own risk.

Please remember that you play a valuable part in security as well. Your password used to access any of our third-party websites or On-line Services, which you select at registration, should never be shared with anyone and should be changed frequently. Furthermore, if you provide any information to parties who operate websites that are linked to or from our website you may be disclosing your Information, and different rules may apply to their collection, use or disclosure of your Information.

While we strive to protect your information by employing reasonable internet security methods and practices, we cannot ensure the security of any information you transmit to us over an unsecured Internet connection. V.  AUTHORIZED USE
While using a Website, you are required to comply with all applicable statutes, orders, regulations, rules, and other laws. You may not use a Website for any fraudulent or unlawful purpose, and you may not take any action to interfere with a Website or any other user's use of a Website. In addition, we expect users of the Websites to respect the rights and dignity of others. By way of example and not of limitation, you may not (and you expressly agree that you will not) do any of the following, which violate this Agreement:

·       Post, upload, share, transmit, distribute, facilitate distribution of or otherwise make available to or through a Website any unlawful, infringing, harmful, harassing, defamatory, threatening, intimidating, fraudulent, tortious, vulgar or otherwise objectionable material of any kind, including unauthorized or unsolicited advertising;

·       Reproduce, duplicate or copy any portion of a Website, except as authorized by this Agreement;

·       Sell, resell or otherwise exploit for any commercial purposes, the use of or access to a Website or any portion thereof without the prior written consent of Bill White Enterprises

·       Impersonate any person or entity, falsely state or otherwise misrepresent your affiliation with any person or entity in connection with a Website, or express or imply that we endorse any statement you make;

·       Violate or attempt to violate the security of a Website;

·       Disseminate on a Website any viruses, worms, spyware, adware or other malicious computer code, file or program that is harmful, invasive or may or is intended to damage or hijack the operation of, or monitor the use of, any hardware, software or equipment;

·       Use any data mining, bots, spiders, automated tools or similar data gathering and extraction methods, directly or indirectly, on a Website or to collect any information from a Website or any other user of a Website; or

·       Assist or permit any persons in violating this Agreement or applicable statutes, orders, regulations, rules, and other laws governing the use of the Websites.

VI.  INTELLECTUAL PROPERTY RIGHTS
All content ("Content") available through the Websites is protected by copyrights, trademarks or other proprietary rights and laws. Except as set forth herein or otherwise agreed in writing by Bill White Enterprises or other rights owner(s), the use of any Content available on a Website is strictly prohibited.

You may use Bill White Enterprises Public Materials from the Websites explicitly made available by the Bill White Enterprises for public use, provided that you (a) keep intact all copyright and other proprietary notices; (b) use the Bill White Enterprises Public Materials pursuant to any associated licenses; (c) obtain consent of any applicable party with respect to third-party copyright, as necessary, (d) use appropriate attribution where feasible (e.g. "Source: Bill White Enterprises, www.bwrestaurants.com); (e) make no modifications to the Bill White Enterprises Public Materials; (f) do not make any additional representations or warranties relating to the Bill White Enterprises Public Materials on behalf of the Bill White Enterprises; and (g) do not use the Bill White Enterprises Public Materials in any way that the Bill White Enterprises deems inappropriate or inadvisable in its sole discretion. Any rights not expressly granted herein are reserved.

VII.  USER-SUBMITTED INFORMATION
You are responsible for any Content you transmit through our Websites. You agree, represent and warrant that any Content you transmit through our Websites or to us is truthful, accurate, not misleading and offered in good faith, and that you have the right to transmit such Content. You shall not upload, post or otherwise make available on or through a Website any Content protected by copyright, trademark or other proprietary right of any third party without the express written permission of the owner of such right(s) or the authority to do so. You shall be solely liable for any damages resulting from any infringement of copyright, trademark or other proprietary rights, or any other harm resulting from such a submission.

We do not want you to, and you should not, send any confidential or proprietary Content to us unless (a) transmitted pursuant to the Bill White Enterprises's regulatory activities; (b) specifically requested by us; or (c) provided as tips/referrals/complaints.

By submitting Content, other than personally identifiable information or bank account information related to payments made through the Websites, you grant to Bill White Enterprises a royalty-free, perpetual, irrevocable and unrestricted right and license (a) to use, reproduce, display, modify, adapt, publish, translate, transmit, distribute or otherwise make available to others such Content (in whole or in part and for any purpose) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed; (b) to exercise all copyright, trademark, publicity, privacy and other proprietary rights with regard to such Content; and (c) to use your name, likeness and/or other biographical information in any and all media and/or communications. You also agree that the Bill White Enterprises is free to use any ideas, concepts, know-how or techniques that you send to us for any purpose.

VIII. COOKIES AND OTHER TRACKING TECHNOLOGIES
We collect information about your usage and activity on our Sites using certain technologies, such as: cookies, web beacons, and other technologies. Third parties may also view, edit, or set their own cookies. We and our third-party service providers, advertisers, and/or partners may also place web beacons for such third parties. The use of these technologies by such third parties is subject to their own privacy policies and is not covered by this Policy, except as required by law.

IX. OPTING OUT
If you do not want to receive marketing and promotional emails from, Bill White Enterprises you may click on the “unsubscribe” link in the email to unsubscribe and opt-out of marketing email communications. Alternatively, to the extent that applicable law requires your prior opt-in consent to receive marketing and promotional emails, you can choose not to opt-in. We will try to comply with your request as soon as reasonably practicable as required by applicable law. Please note that we may need to retain certain information for recordkeeping purposes, to complete any transactions that you began prior to your request, or for other purposes as required or permitted by applicable law. In addition, please note that even if you opt-out of receiving marketing communications from one or all of our Sites, we may need to send you service-related communications and may need to keep information we have collected about you for record-keeping, research, and other purposes.

Our Sites may contain links to other websites or services that are not owned or controlled by Bill White Enterprises including links to websites of third-party software, sponsors, social channels and partners. This Policy only applies to information collected by our Sites. We have no control over these third party websites, and your use of third party websites and features are subject to privacy policies posted on those websites. We are not responsible or liable for the privacy or business practices of any third party websites linked to our Sites. Your use of third parties’ websites linked to our Sites (“Linked 3rdParty Websites”) is at your own risk, so we encourage you to read the privacy policies of any these Websites when you leave one of our Sites. XII. CHANGES TO THIS POLICY
Except to the extent limited by applicable law, we reserve the right to update this Policy to reflect changes to our information practices by prominently posting notice of the update on our Sites, and as required, obtaining your consent. Any updates will become effective immediately after posting the updates to this Policy and apply to all information collected about you, or where required, upon your consent. You agree that you will review this Policy periodically. If we make any changes to this Policy, we will change the “Last Updated” date above. You are free to decide whether or not to accept a modified version of this Policy, but accepting this Policy, as modified, is required for you to continue using our Sites. If you do not agree to the terms of this Policy or any modified version of this Policy, your sole recourse is to terminate your use of our Sites.  If we make any changes to this Policy that materially impacts previously collected information about you, we will obtain your prior express consent.

XIII. CHILDREN
Bill White Enterprises’s web sites are not directed at individuals less than thirteen (13) years of age, and Bill White Enterprises does not intend to collect any Personal Information from such individuals, unless otherwise stated at the time such information is collected. If a child under 13 submits Personal Information to Bill White Enterprises and we learn that such Personal Information is the information of a child under 13, we will attempt to delete the information as soon as possible.

XIV. OPTING IN
If you reside in the U.K. or E.U., before submitting any Personal Information, you must first “opt in” and accept the terms and conditions of this Policy.  To opt in and accept such terms and conditions, please check the box located on the Site near where you will input Personal Information.
